 Injury on Carpet Field Counted as Occupational Accident


The Supreme Court ruled for an occupational accident for the employee who was injured during the match played in the company's carpet field team.


The football team of the company, which was established in line with the instructions of the employer, played a football match in the tournament organized with the football team of another company. The employee who was injured during the match claimed that the incident was a work accident and the necessary rights were not met by the employer. After years of legal processes, the decision was made by the 10th Civil Chamber of the Supreme Court for the disability experienced by the employee who brought the case to court. It was determined that the incident in question was an occupational accident.

Situations Counted as Work Accidents

Social Insurance and General Health Insurance Law No. 5510 includes the definition, scope, qualifications of work accident and in which cases it will be considered as work accident. Incidents that cause damage to the insured during all periods, including the insured's being in a place other than the workplace due to his/her duty and his/her commute are considered as work accidents.

If the employees who are assigned outside the workplace have a longer duty period than the working hours, they should be considered as occupational accidents not only while doing their job but also in the events they have experienced in their daily activities.

Decision Precedent

The related incident has been evaluated within the events that the insured person, who works at the workplace in subparagraph c of Article 13 of the Law No.

As a result, it was decided that the incident was an occupational accident in the case that all expenses for participating in the tournament, including the provision of a shuttle bus for the football team, which was established by the employer's instructions, were covered by the company.
