Held in Istanbul on 12 and 13 January 2023, the '10. Speaking at the Turkish Code of Obligations Workshop” Mehmet Akarca, President of the Supreme Court of Appeals, touched upon the importance of scientific opinions.
Making the opening speech at the workshop organized by the Ministry of Justice, the President of the Court of Cassation Mehmet Akarca said, "The interaction and harmony of rich and quality scientific opinions and judicial practice is an indispensable condition for a well-functioning legal system." He emphasized the importance of the doctrine in the legal system.
President of the Court of Cassation Akarca stated that a good functioning of the legal system is a must for a country and that the functioning of the legal system will contribute to social peace, welfare and state order. Referring to the importance of teaching in his speech, Akarca said that teaching is equally important for the legal system as much as legislation and judiciary.
Continuing his speech, Akarca made evaluations about the Turkish Code of Obligations and added that the Turkish Code of Obligations is one of the basic laws for social peace and order, and that there are many decisions and knowledge in the implementation of the law. Akarca also stated that the fact that the provisions of the abrogated Code of Obligations No. 818 were largely included in the Turkish Code of Obligations No. 6698 had a positive effect, and that the harmonization process of the new law with Turkish law was easily overcome.
Apart from the President of the Court of Cassation Mehmet Akarca, Minister of Justice Bekir Bozdağ and the General Director of Legal Affairs of the Ministry of Justice Hakan Öztatar also made opening speeches.
