The interview with the President of the Court of Cassation Mehmet Akarca was published in the 22nd issue of Anadolu Adliyesi Magazine. Akarca shared his knowledge and views on various issues in the interview.
Answering the questions of İsmail Değirmenci and Ahmet Aslan in the interview in the 22nd issue of Anadolu Adliyesi Magazine dated January 2023, President of the Court of Cassation Mehmet Akarca made evaluations about current legal practices.
Evaluating the three-stage structure that was first passed on 20 July 2016, Akarca stated that the radical change is a milestone for the Turkish judiciary. He emphasized the necessity of the appeal system by stating that the workload of the Court of Cassation was much higher before the application of the appeal system and the number of files had exceeded one million. Akarca also added that the necessary reforms in the transition from the two-stage structure to the three-stage structure have not been completed yet, and that the structural problems must be overcome. In this regard, he also touched upon the risks of the appeal system.
Evaluating what are the necessary judicial reforms on a question asked in the interview, Akarca said that the evaluation of the working procedures to prevent the formation of case-law differences, the possibility of appealing in order to contribute to the development of the law in the cases that are not subject to appeal, the fact that the appellate authority can handle some cases as a court of first instance, that the decisions rendered in some cases are subject to appeal. He stated that there is a need for reform on issues such as bypassing the appeal stage and sending direct appeals. In this respect, Akarca cited the practices in European countries such as France, Spain and Italy as an example and stated that similar systems could be adapted to the Turkish judicial system.
