 Lawyers Are Required to Have Pos Devices


The Revenue Administration prepared the draft of the Tax Procedure Law General Communiqué that will make it mandatory for lawyers to have a pos (point of sale) device.


The Revenue Administration prepared the draft of the Tax Procedure Law General Communiqué that will make it mandatory for lawyers to have a pos (point of sale) device.
If the Communiqué goes into effect, it will be mandatory for lawyers to have POS devices with credit card readers. Now every lawyer will have a pos device. Considering that the vast majority of lawyers do not have a POS device and they receive all payments in cash, it can be said that many lawyers will have to acquire POS devices shortly.
After this communiqué of the Ministry of Treasury and Finance Revenue Administration comes into force, lawyers will still be able to receive payments in cash, although they have to have a POS device.
The option of making the payment in cash or by credit card will be determined by the agreement between the client and the lawyer. However, lawyers will also be exposed to additional financial burdens such as purchasing a POS device, paying a certain monthly fee, and paying commissions on fees.
According to the draft communiqué, the obligation to have a pos device begins as of April 1, 2023. The lawyer of the pos device at work
will be mandatory. Lawyers who start to work after this date will have to obtain a POS device within one month from the date of starting work.
Appreciation and evaluation letters were sent to the Revenue Administration of the Ministry of Treasury and Finance by the Union of Turkish Bar Associations and the Istanbul Bar Association to prevent the draft communiqué from entering into force. In the Communiqué, the same obligation is foreseen for financial advisors as well as lawyers.
